Terms that apply to inquiries, quotes and sales of industrial equipment and components from Servicio Zaragoza, LLC.

These Terms of Service (“Terms”) apply to the use of serviciozaragoza.com and to inquiries, quotes and sales of industrial machinery, equipment, parts and components by Servicio Zaragoza, LLC (“Seller,” “we,” “us”), 520 N Pierce St, Eagle Pass, TX 78852. By requesting a quote, placing an order or using this website, you (“Customer”) agree to these Terms. A written quote or agreement signed or issued by us may add to or modify these Terms for a specific transaction.
1. Industrial Equipment and Component Sales
We supply industrial machinery, equipment, replacement parts and components to commercial and industrial customers. Products are sold for business use. The Customer is responsible for selecting products suitable for its equipment, application and intended use.
2. Product Inquiries
Submitting an inquiry or quote request through the website, by email or by phone does not create an order or obligate either party to buy or sell. Information on this website describes general product categories and is not an offer for sale of any particular item.
3. Quotes and Pricing
Quotes are prepared from the information the Customer provides and are valid only for the period stated on the quote. Prices are stated in U.S. dollars and may change before an order is accepted. Unless stated otherwise, quotes do not include shipping, freight, handling, duties or applicable taxes. We may correct errors in quotes or invoices.
4. Product Availability
Availability is confirmed individually and is not guaranteed until we confirm an order in writing. Lead times, if provided, are estimates. If an item becomes unavailable, we will contact the Customer to discuss alternatives or cancellation.
5. Customer Specifications
The Customer is responsible for the accuracy and completeness of the specifications, part numbers, models, quantities, measurements and application details it provides. We source items according to the information supplied and are not responsible for errors or omissions in Customer-provided information, or for fitness of a product for a purpose not disclosed to and confirmed by us in writing.
6. Purchase Orders
Where a Customer issues a purchase order, it must reference the applicable quote. An order is accepted only when we confirm it in writing or begin fulfillment. Terms on a purchase order that conflict with these Terms or our quote do not apply unless we agree to them in writing.
7. Payment; Invoices; Deposits and Advance Payments
Payment is generally made by invoice. Payment terms, accepted payment methods and due dates are stated on the quote or invoice. Where indicated on the quote, a deposit or advance payment may be required before we order, special-order or ship items. Late or unpaid invoices may result in suspension or cancellation of orders. The Customer is responsible for applicable taxes unless a valid exemption or resale certificate is provided to us.
8. Order Changes and Cancellations
Requests to change or cancel an order must be made in writing as soon as possible. Changes and cancellations are accepted only if the order has not yet been placed with a supplier or shipped. Special-order, custom, non-stock or already-ordered items may not be cancellable, and deposits or advance payments related to them may be non-refundable in whole or in part to cover costs incurred.
9. Shipping and Delivery
Shipping method, charges and delivery terms are stated on the quote or invoice. Delivery dates are estimates and are not guaranteed. Risk of loss passes to the Customer upon delivery to the carrier or the agreed delivery point, unless we agree otherwise in writing. We are not liable for delays caused by carriers, suppliers, customs, weather or other events outside our reasonable control.
10. Receiving and Inspection
The Customer must inspect goods upon receipt. Visible damage, shortages or errors should be noted on the carrier’s delivery documents where possible and reported to us in writing within a reasonable period (and in any case within seven (7) days of delivery), with photographs where available. Failure to report promptly may affect the Customer’s ability to make a claim.
11. Returns
Where returns are available, they must be authorized by us in writing before anything is sent back. Returned items generally must be unused, in original condition and packaging, and accompanied by proof of purchase. Special-order, custom, cut-to-length, non-stock or used items may not be eligible for return. Return shipping costs and any restocking or supplier charges may apply. Items shipped back without authorization may be refused.
12. Manufacturer Warranties
Products are sold with a manufacturer’s warranty only where the manufacturer actually provides one. We do not create or extend any warranty of our own except as stated in a writing signed by us. To the extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Where a manufacturer warranty applies, warranty claims are handled under the manufacturer’s terms, and we will make reasonable efforts to assist the Customer in submitting a claim.
13. Limitation of Liability
To the fullest extent permitted by law, Servicio Zaragoza, LLC will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of use, downtime or business interruption, arising from the sale, use or inability to use any product or from the use of this website. Our total liability for any claim relating to a sale will not exceed the amount the Customer paid to us for the specific product that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Safe Use and Installation
Industrial equipment and hydraulic components can be dangerous if selected, installed or operated improperly. The Customer is responsible for qualified installation, compliance with applicable safety requirements, and following manufacturer instructions.
15. Website Use
This website is provided for general information about our business and to submit inquiries. We work to keep the information accurate but do not warrant that it is complete or error-free. We may update the website and these Terms at any time; the “Last updated” date shows the latest revision.
16. Governing Law
These Terms and any transaction with us are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising from these Terms or a sale will be brought in the state or federal courts located in the State of Texas, and the parties consent to their jurisdiction.
